One of our main areas of activity is national and cross-border real estate transactions and real estate portfolio transactions in all asset classes (in particular office buildings, shopping and retail centers, logistics properties and industrial properties, as well as hotels and residential properties). Our advisory services include the structuring of real estate transactions as asset deals or share deals, legal due diligence, contract drafting and negotiation to the assumption of trusteeships and settlement with the land register.

Our real estate team has extensive experience with distressed real estate assets, with the sale of distressed properties forming an important part of our advisory practice. Together with our insolvency law experts and the experts from Deloitte Tax and Financial Advisory, we also support our clients in complex real estate restructuring projects (e.g., restructuring of real estate portfolios or real estate companies) and in complex real estate realizations.

Our core competence includes legal and strategic advice on national and international real estate financing. We advise banks, insurance companies, institutional investors and other financial service providers on national and cross-border real estate finance transactions and real estate leasing transactions. We also advise family offices on real estate investments and mezzanine financing for real estate transactions.

Another important part of our practice is advising our clients on commercial leases and residential leases as well as asset and property management. Our commercial tenancy law expertise covers all asset classes, in particular shopping centers and retail parks, retail properties, office buildings as well as logistics and industrial facilities.

We support our clients in all matters relating to condominium ownership, from the establishment of condominium ownership, questions about the ownership partnership, letting/leasing and management of condominiums, to the transfer of condominium properties.

The handling of property development projects is also part of our range of services. We support our clients throughout the entire project cycle, from the purchase of a property, support with urban development contracts, zoning issues, contractual documentation for the construction of the building through to the sale of the individual properties.

The drafting and negotiation of total/general contractor agreements, architect contracts, asset management contracts or service agreements are also part of our range of advisory services.

Our day-to-day practice naturally also includes public real estate law, in particular the areas of regional planning and zoning, land transactions, forestry, water and environmental law as well as building law and commercial law (e.g. business premises licensing procedures). We also provide support in expropriation and rezoning proceedings.

Urban Development Contracts – Project Development: We also assist our clients in drafting urban development contracts (in particular for residential developers), in urban development procedures in urban development areas or in large-volume public infrastructure projects with municipalities (e.g., sports facilities).

We represent our clients in court and arbitration proceedings as well as before authorities and administrative courts. Support with alternative conflict resolution is also part of our range of services. In addition, we take on the structuring and implementation of receivables management and the enforcement of claims (in particular with regard to claims for interest and ancillary costs, eviction proceedings, proceedings in connection with residential property, claim management).

The topic of sustainability is becoming increasingly important in the real estate industry. We advise our clients on contracts throughout the entire life cycle of a green building, in particular in the areas of green leases, construction and facility management.
